These terms and conditions apply to trips arranged by Tour Mandalay Pty Ltd (Company Registration Number 606/1994-1995, License Number KHA/0212) whose registered head office is at 02/03 2nd Floor, Pearl Condominium A, Kabar Aye Pagoda Road, Bahan Township, Yangon 11201, Myanmar. By making a booking you confirm your acceptance of these terms and conditions and agree to be legally bound by them.

Deposits and payments
When you make a booking, we will request for the arrangements included in the itinerary to be booked. During this process, your booking is subject to availability and is not confirmed until we have emailed you a formal confirmation.

Tour Mandalay are bound by the terms and conditions of the operators we work with in Myanmar, many of whom require a deposit to secure their services. We require a deposit of 50% to confirm the arrangements and by making a booking you give consent for us to invoice you for these costs and agree to any associated penalties should you wish cancel the booking.

You agree to provide us with full passport details of all passengers travelling as is required by Myanmar law to register foreign tourists. You also agree to provide any other personal information we require to confirm the arrangements, including but not limited to, passport copies and body weights (this is necessary for hot air balloon flights for example). We will inform you of these requirements at the time of booking.

Final balance payment can be made on, or before your scheduled day of arrival into Myanmar. A formal invoice will be issued confirming this amount as soon as the above mentioned deposit amount has been received.

All payments should be made by wire transfer in US dollars and confirmation emailed to Tour Mandalay. We regret that we cannot accept payment by cheque, debit or credit cards at this time. Details required to facilitate the bank transfer will be advised at the time of booking (currently we are only able to accept payments made in USD, EUR and SGD).

Amendments made by us
Tour Mandalay reserve the right to change prices as a result of new or increased taxes and charges, changes in exchange rates or equivalent circumstances over which we have no control or could not have foreseen. We agree to absorb price increases of up to USD 25 per person, but amounts of more than USD 25 per person will be passed on to you. We try to be as flexible as possible with our policy and approach each situation on a case by case basis, hence are open to negotiation in the event of any such rate increases.

We also reserve the right to alter routes, itineraries or departure times without prior notice, should the necessity arise. In such circumstances, we will advise you of our course of action immediately.

Amendments made by you
We will do our best to fulfil all requests for changes to an itinerary. Tour Mandalay will not charge amendment fees at any stage of the quotation or booking process, however, some suppliers we work with do impose penalties for changes and we are obligated to pass these on to you. We will advise you of the applicable penalties before making any amendments.

Cancellation and refunds
For confirmed bookings:

  • Hotels cancelled within 60 days of departure are non-refundable.
  • Guide, car and entrance fees are fully refundable at any time before travel. Tour Mandalay are bound by the policies of the hotels, cruises, restaurants and other local suppliers we work with whose policies are often more restrictive than the above. Any additional penalties by these parties will be passed on to you directly. If you request for a booking to be cancelled, we agree to advise the applicable charges and wait for your consent before proceeding.

Data protection
We are responsible for ensuring proper measures are taken to protect the personal information you provide us. This may include but is not limited travelling passengers names, passport details, ages, religion, disabilities, dietary requirements and other special requests. The information you provide will be used to ensure your travel arrangements are processed correctly and without it we cannot confirm your booking. The information may also be provided to public authorities such as customs and immigration if required by them, or as required by law.

Data protection controls in the region in which we work may not be as robust as the legal requirements in your home country but you can be assured that Tour Mandalay will not pass personal information to any person not responsible for part of your travel arrangements. By making a booking with us you agree to the information you provide to being passed on to our suppliers, wherever they may be based.

Limitation of liability
Tour Mandalay claims no responsibility for loss, damage, sickness, injury or schedule change due to weather, natural disaster, terrorist activities, strike, political tension or other cause beyond our control. We also cannot be held responsible for the fault of any agent, hotel, airline, operator, guide or service that consequently impacts an itinerary. Although Tour Mandalay acts in good faith and we make every effort to safeguard passengers travelling with us, we recommend taking out comprehensive travel insurance to meet all possible contingencies.
